Terms of Service

These terms govern the use of the ExportAI platform, provided by Pablo Szelagowski, Calle 53 Nº 416, La Plata, Buenos Aires, Argentina (the "Provider"), to the companies that hire it (the "Client"). If the Client has signed a specific agreement with the Provider, that agreement prevails over these terms.

1. The service

ExportAI is a platform for commodities trading, documentation and container tracking, with integrated artificial intelligence. Each Client works in its own workspace and manages the users who can access it. The Client is responsible for the activity of its users and for keeping their credentials secure.

2. Fees and payment

The use of the platform is billed monthly, unless agreed otherwise with the Client. Billable developments are included in the invoice for the month in which they were carried out. If a payment is overdue, the Provider may suspend the service after notifying the Client.

3. Developments

A development requested by the Client is billable when at least one of these conditions applies:

  • Specific development: it responds to a way of working particular to the Client and does not apply to the rest of the clients.
  • Imposed deadline: the Client needs it done within a specific time frame.

Suggestions that improve the system as a whole and can be applied to all clients without particular adaptation may be implemented at no additional cost, at the Provider's discretion. Fixing errors in the system is never billed.

Before a billable development, the Provider may send an estimate. The Client can adjust the urgency, scope or complexity to fit its budget. No price is ever imposed without the Client's consent.

4. Intellectual property

The platform, its architecture, modules, features, source code and its present and future evolutions are the exclusive property of the Provider. The Client receives a right to use the platform and acquires no rights over the software, its source code or its reproduction, modification or exploitation.

The platform is a shared tool: general improvements are funded by the Provider and benefit all clients, while each Client funds only the specific developments it requests.

5. Client data

All data entered, generated or stored by the Client in the platform (commercial, operational and financial data, contacts, documents and any other information about its activity) is and remains the exclusive property of the Client. The Provider:

  • acquires no rights over that data and does not use it for its own purposes;
  • does not transfer, sell or share it with third parties;
  • accesses it only as needed to keep the system working, carry out maintenance and provide support;
  • keeps it strictly confidential, except when the law requires otherwise.

See the Privacy Policy for details on how personal data is handled.

6. Service continuity

The Provider has designated people responsible for continuity who can maintain the platform and keep it running if the Provider cannot fulfil its obligations due to force majeure, incapacity, prolonged absence or any other situation that prevents the normal maintenance of the service.

7. Acceptable use

The Client must not use the platform for unlawful activities, try to access other clients' workspaces or data, or interfere with the operation or security of the service.

8. Changes

The Provider may update these terms. The new version will be published on this page with its date and, if the changes are significant, clients will be notified through the platform.

9. Contact
